Obituary notices are posted on our Web site, www.baxterbulletin.com Lawsuit filed over error in Ark marriage law BENTONVILLE (AP) The mother of a 17-year-old girl filed a lawsuit Thursday to attempt to get her daughter a marriage license, the first legal challenge to a legislative error allowing Arkansans of any age to marry.

The suit, filed in Benton County Circuit Court, claims a legislative code revision commission overstepped its boundaries when eliminating a "not" from a clause in a law passed this year. That "not" allowed anyone under 18 who is not pregnant to marry with parental consent. Lawyer Tim Hutchinson, a former Republican state representative representing the mother, said the 17-year-old girl from northwest Arkansas was engaged to an 18-year-old she met in high school. The lawsuit shows the girl, who said she's not pregnant, tried to get a marriage license Aug. 3, but was turned away by the Benton County Clerk's Office.

"I don't think you can call it extraneous. It's pretty significant," Hutchinson said of the revision. "It's only one word, but its a pretty significant word." The suit seeks a marriage license for the teenagers, as well as court costs and fees. In Boone County, deputy clerk Lynda Treat said a 17- year-old pregnant girl there received a marriage license after showing proof of Osburn asks for delay in capital murder trial ARKANSAS CITY (AP) The man accused of murdering a Pine Bluff teenager who ran out of gas along a highway i in Desha County has asked for a delay in his trial that is to start next week. Kenneth Osburn is accused in the August 27, 2006, slaying of Casey Crowder, 17.

Prosecutor Thomas Deen is seeking the death penalty. Lawyers for Osburn said in court papers they need more time to prepare because it's a death penalty case. Defense lawyers also said several key witnesses won't be able to testify if the trial starts next Thursday. Among them is Arkansas State Police Special Agent Rick Newton, a lead investigator who is recovering from injuries from an accident. Defense lawyers said the doctor who performed the autopsy on the victim won't be available, either.

Osburn's lawyers further argued that the original trial date coincides with the local harvest season and may affect the availability of potential jurors. www.baxterbulletin.com There is a difference! Bull Shoals man injured in crash A Bull Shoals man was injured in a Wednesday crash. About 2 p.m., Keith Collard, 64, was driving north on State Highway 178 about one-tenth of a mile north of Fairview when he lost control of his vehicle in a curve and hit a barbed-wire fence, according to an Arkansas State Police news release. Collard was charged with careless driving.

He was treated and released from Baxter Regional Medical Center, a hospital spokeswoman said. Gamaliel teen injured in crash A Gamaliel woman was injured in a Thursday crash. About 10:30 a.m., Kristen Rivas, 18, was driving north on State Highway 101 behind a vehicle driven by James Kullman, 21, of Mountain Home, according to an Arkansas State Police news release. Kullman made a left turn onto the highway into a private drive, but Rivas was unable to stop and hit the back of his vehicle, according to the release. Rivas was charged with following too closely, according to the release.

She was treated and released from Baxter Regional Medical Center, a hospital spokeswoman said. Kullman was charged with failing to provide proof of insurance. From submitted reports parental permission. Treat said she followed the law, as amended by the code revision commission, when issuing the license. Carroll County Clerk Shirley Doss said she and many others who recently attended a meeting of the state's county clerks decided to keep enforcing the old law until the matter can be determined.

That law allows girls at least 16 and boys at least 17 to marry with parental consent. Younger marriages require a court order. This year's bill, introduced by Rep. Will Bond, D- Jacksonville, was intended to establish 18 as the minimum age to marry and allow pregnant teenagers to marry with parental consent. However, Bond said the legislation got "screwed up" during its drafting.

The revision commission typically fixes typographical errors in laws. Legislators in August said the commission went beyond its powers and changed the substance of the bill by correcting the error. Some called for a special legislative session to fix the error, worried pedophiles might try to exploit the law. Gov. Mike Beebe has said there is no "imminent crisis" that would require a special legislative session to fix the law.
